However, the plaintiffs are alleging that the project represents a 'rug pull' scam, asserting that despite frequent updates from the project team, tangible progress in developing the club has yet to materialize.

According to the lawsuit, NFT holders were enticed with numerous perks, including:

  • Exclusive entry into the Meta Eagle Club

However, the plaintiffs assert that only a handful of tickets for these events were distributed. They also received a limited number of physical artworks and two events branded as Galyverse experiences.

It was claimed that after a January 12, 2023 vote on Eden Gallery’s Discord, there was a significant reallocation of the remaining project funds, diverted into what the team referred to as 'alternative utilities' to maintain a marketplace, a response attributed to an ongoing market downturn.

The plaintiffs have brought forth serious allegations, which include common law fraud, unjust enrichment, and violations of New York General Business Law. Their demands include:

Additionally, in May, Italian fashion brand Dolce & Gabbana and digital asset platform UNXD faced legal challenges related to delays in NFT product deliveries.

The NFT market is experiencing substantial difficulties, as highlighted in an August 20 report from NFT Evening, which noted that approximately 96% of the 5,000 NFT collections evaluated are deemed 'dead' as we advance into 2024.
